Description | DSCAM/5/8/9/1-2: Lease (27 July 1813) by Mary Hawkes of Dudley, Worcs., widow, Thomas Hawkes of Himley, Staffs., Esq. and George Wright Hawkes of New York, United States of America (surviving trustees under the will of Abiathar Hawkes of Dudley, glass merchant), the said Thomas Hawkes (entitled to an equitable estate of one sixth in his own right), the said George Wright Hawkes (so entitled), Roger Wright Hawkes of Dudley, Esq. (so entitled), the Revd Robert Crockett of Fordhall, Salop, Clerk, John Michael Malonek of Liverpool, Lancashire, Esq., John Atkinson of Salford, Lancashire, merchant and John Watson Borradaile of Fenchurch Street, City of London, merchant (as trustees of the marriage settlement of Abiathar Hawkes, now a Captain, 21st Light Dragoons, and Mary Ann Borradaile; so entitled), and the said Abiathar Hawkes and Mary Ann his wife, the said George Wright Hawkes and Henry Crockett of Liitle Onn, parish of Church Eaton, Staffs., Esq. (as trustees of the marriage settlement of Robert Crockett and Maria Wright Hawkes; so entitled), and the said Robert Crockett, and the said Roger Wright Hawkes and Abiathar Hawkes (as trustees of the marriage settlement of John Michael Malonek and Sarah Hawkes; so entitled), and the said John Michael Malonek and Sarah his wife, to Richard Salisbury, late of Belfast, now of Dudley, Esq., Paul Tate of the City of London, Esq., Robert Keate of Curzon Street, May Fair, City of Westminster, surgeon and Francis Home, Esq., a Captain in the 3rd Regiment of Dragoon Guards, of 13 closes of land at Dixons Green, parish of Dudley (39 acres; extending from the Dudley-Hales Owen turnpike to the Anabaptist Meeting House; as specified, with names and acreages); and a messuage, a cottage, Farther Aston Barbors (3 acres), a barn and 4 acres of land, and Hither Aston Barbors (2 acres), all together at Netherton in the parish of Dudley; and Finch's Furlong (1a. 3r. 30p.), the top of Cooks Tetnall (3r. 4p.) and another close thereabouts (2r. 18p.), and seven-eighths of lands called Ashton Barbors and Stubble Leasow, near the said Anabaptist Meeting House at Netherton; and all minerals; for a term of 40 years from 24 June 1813; at a rent of £13 p.a. (the current rent) for the various dwellinghouses, £4 10/- an acre p.a. for surface rents, 1s 6d per ton for Thick Coal, Heathen Coal etc. during the time that the market price for such coals does not exceed 8/- a ton, plus various fall and rise provisions related to the net price and colliers' wages, 2/- a ton for ironstone, 4d per sack of coke and 5d per ton of slack, 1s 6d per 1000 bricks made, with a minimum quarterly payment based on 500 tons of coal and 100 tons of ironstone a week; complex provisions for undeworking and overworking, arranged differently for the first 2 years of the term and the rest; working covenants; plans endorsed. And endorsed (6 May 1819) covenant between the parties regarding the assignment of shares under the lease, for which the lessors' consent is required by the terms of the lease; reciting #3 below, and the recent agreements for the assignment of the shares of Hone to the other partners and byTate to Salisbury

DSCAM/5/8/9/5: Release [lease wanting] (22 Oct. 1813) by John Robinson of Birmingham, Warwickshire, brass founder, to Richard Salisbury of Dudley, Esq., Robert Keat, Paul Tate and Thomas Hawkes, of a close of land adjoining the Baptist Meeting House at Netherton, parish of Dudley, commonly called the Acre and formerly described as 4 ridges in a close called Ashton Barbers, to the various partners in sixths and thirds (proportionate to their partnership interest), with power of appointment, as specified, the partners variously acting as trustees to uses for each other; consideration of £420. |
