DescriptionDSCAM/5/8/7/40: Release (1832) by Sarah Malonek of Leamington Priors, Warwickshire, widow, and William Middleton of the same, surgeon and Constantia his wife and George Ricketts Wilkinson of Tapton House, Derbyshire, Esq. and Emily his wife (the ladies being the only children of Malonek to be of age), of the trustees of the settlement made prior to Mrs Malonek's marriage [#16 above] - Roger Wright Hawkes and Abiathar Hawkes; recites her marriage settlement, the loss of settled funds advanced to her husband at their joint request through his insolvency; with permission of the trustees she has appropriated other trust monies for maintenance.
DSCAM/5/8/7/41: Undertaking (6 Jan. 1836) by Wootton Wright Hawkes, as agent for his mother, to procure a release of Edward Dixon, the surviving trustee of the marriage settlement of his mother and Captain Bolton, in respect of £2816 to be paid into Mrs Bolton's account with Coutts and Company; recites deed of 20 Oct. 1834 whereby he assigned to his mother, Ann Lawrance Bolton, wife of Captain Daniel Bolton of Bytown, province of Upper Canada, North America, his interest in the estate of his late father, George Wright Hawkes.
DSCAM/5/8/7/42: Life assurance policy of Abiathar Hawkes, Master of Ceremonies at Leamington Priors, for £800 with The Manchester Fire and Life Assurance Company, 4 Feb. 1836.
DSCAM/5/8/7/43-44: Notice from Abiathar Hawkes, a Major in HM 39th Regiment of Foot, to the trustees of his marriage settlement [#19 above], of the grant of an annuity of £200 to James Henry Leckie of Bedford, Bedfordshire, Esq., late a Captain in the same regiment, for a term of 19 years, should Leckie and his 3 daughters (Frances Ann Leckie, Sophia Hilton Leckie and Elizabeth McClure Leckie) be living, and of his assignment of his sixth share of the residuary estate of his late father, Abiathar, and the income from £1084 3% Consols, in which he has a life interest, to secure the annuity; and he waives the sum in his settlement of £2500 set aside for purchasing a rank in the army etc., during the continuance of the annuity; 20 Feb. 1836. Judgment of Leckie against Hawkes for £4000, in the Common Pleas, 29 Feb. 1836 [additional security].
DSCAM/5/8/7/45: Lease and release and assignment (18-19 Mar. 1836) of the real and personal estate of George Wright Hawkes deceased, by Roger Wright Hawkes, late of Dudley, now of Chelsea, Middlesex, Esq. (sole acting trustee of the will dealing with the real estate of George Wright Hawkes) and Wootton Wright Hawkes of New York, United States of America, at present residing at Dudley, Esq. (son, heir and only surviving child of George Wright Hawkes), at the request of Daniel Bolton, Esquire, a Captain in HBM Corps of Engineers, stationed at Bytown, Province of Upper Canada, North America and Ann Lawrance his wife (previously wife of George Wright Hawkes), to John Jones of Liverpool, Lancashire, merchant (a trustee for Ann Lawrance Bolton), to effect a confirmation of the deed of 20 Oct. 1834; viz. one sixth of messuages, lands and minerals at Blowers Green, at Scotts alias Scotts Tenement, now Dancers Land, Scott's Green, of a messuage, a cottage, 3 acres of land called Farther Aston Barbers, a barn and 4 acres, and 2 acres called Hither Aston Barbers, all together at Netherton, of Finch's Furlong (1a. 3r. 30p.), Cook's Tetnall, Ashton Barbors and Stubble Leasow, Netherton and of all erections upon these lands, all in the parish of Dudley, and a moiety of the glass house, warehouse etc. at Horse Pool Green, Dudley (formerly described as 6 or more tenements), to the use of Mrs Bolton, with power of appointment, as specified; assignment of one sixth share of 13 closes of land (specified) at Dixons Green for the residue of a term of 1000 years from 1766, and of all monies and securities and personal effects, in trust for Mrs Bolton; consideration of $5000 [the consideration in the 1834 deed] = £1125; recites the will etc., deaths of beneficiaries and subsequent deeds; 1834 assignment by Wootton to his mother under US law, voyage to England to sort out all affairs.

Attached official notice that Daniel Fisher [who has witnessed the signature of Mrs Bolton] is a Justice of the Peace for the District of Bathurst, Province of Upper Canada, 4 July 1836.
DSCAM/5/8/7/46: Release (21 Mar. 1836) by Thomas Hawkes of Himley, Staffs., Esq., at the direction of the Boltons, to Jones, of the legal estate vested in him as surviving trustee under the will of Abiathar Hawkes in G.W. Hawkes's one sixth share in the residuary estate of Abiathar, viz. a sixth of a messuage cottage, Farther Aston Barbors, the barn and land, and Hither Aston Barbors, and in Finch's Furlong ... Stubble Leasow etc., and assignment of one sixth of the 13 closes of land, upon the trusts as in #45.
DSCAM/5/8/7/47: Release of claims (9 Apr. 1836) by Wootton Hawkes and the Boltons, to Roger Wright Hawkes (as sole trustee of the will dealing with the real estate of G.W. Hawkes) and Thomas Hawkes and Roger Wright Hawkes (as exexutors of the will dealing with the personal estate of G.W. Hawkes)
DSCAM/5/8/7/48: Assignment (8 July 1836) by the Revd Robert Crockett, late of Nailston, Leicestershire, now of Calais, France, Clerk, to Thomas Badger of Dudley, Esq. of his share in the several sums of £600, £600, £200 and £600 (monies secured on the tolls of the Pedmore and Holly Hall turnpike) under the will of Abiathar Hawkes and his marriage settlement of 13 Oct. 1802; consideration of £135; recites previous deeds.
DSCAM/5/8/7/49: Copy of the will (date 19 Oct. 1831) of Roger Wright Hawkes of 3 Park Place, Suffolk Square, Cheltenham, Gloucestershire; all to wife Elizabeth, who is sole executrix. Proved, 1 May 1837.
DSCAM/5/8/7/50: Notice to the trustees of Major Abiathar Hawkes's marriage settlement of the assignment of the annuity of 1836, by Leckie to Thomas and Isaac Badger of Dudley, merchants, 10 June 1840.
DSCAM/5/8/7/51: Assignment (23 Jan. 1843) by Abiathar Hawkes, once of Dudley, then Leamington Priors, now resident at Calais, France, Esq. (surviving trustee of the 1806 marriage settlement [above]), and (as to their reversionary interest after the death of their mother) by John Malonek late of Leamington Priors, now resident at Brussels, Belgium, gentleman, William Middleton of Leamington Priors, surgeoan and Constantia his wife, George Yeldham Wilkinson late of Leamington Priors, now of Brussels, Esq. and Emily his wife, Mary Malonek, late of Leamington Priors, now also of Brussels, spinster, to Sarah Malonek, also late of Leamington Priors and now of Brussels, widow (mother of John, Constantia, Emily and Mary), of the one sixth share in the freehold and leasehold parts of the Buffery Estate, Dudley (under the will of Abiathar Hawkes deceased); recites Mrs Malonek's marriage settlement and subsequent deeds and events, loss of part of trust monies transferred to Mr Malonek's business in his bankruptcy and agreement not to prove debt against his estate; use of various other trust monies to support the family.
