DescriptionDSCAM/5/6/5/12: Copy release by way of mortgage (24 Sept. 1831) by Richard Homer of Dudley, Worcs., maltster and Rachel his wife, to Joseph Bridgwater of Dudley, maltster, of their one fifth share of the minerals under an undivided moiety of 4 parcels of land called Bourne Hills near the Knowle, and under three parts of a messuage and 5 closes of land in the parish of Rowley Regis, to secure £400 already advanced; covenant to levy a fine. Extensive marginalia. [For validity see #41-42 below.]
DSCAM/5/6/5/13-14: Attested copy mortgage by lease and release (dated 21-22 Oct. 1836) by Joseph Bridgwater and Sarah his wife, to Isaac Badger of Dudley, Worcs., iron merchant and Philip Williams of Wednesbury Oak Ironworks, ironmaster [as trustees for the Dudley and Westbromwich Banking Co.] of messuages, malthouses, store rooms and stable in Castle Street and Fisher Street, Dudley, as specified, the reversion in a further messuage in Fisher Street after the death of John Degrey and wife, three fourths of premises near the Knowle, parish of Rowley Regis, one fourth of 10 messuages in and near High Street, Dudley, a further fourth share in the same, a sixth share in 4 pieces of land at Bourne Hills near the Knowle, and all his interest in the underlying minerals, subject to a variety of prior mortgages as specified, to secure a sum not in excess of £5000. And notice to King and Round of Joseph Bridgwater's mortgage of the equity of redemption of the Rowley Regis property; 22 Oct. 1836. [See also DSCAM/5/6/1/18 etc.]
DSCAM/5/6/5/15: Conveyance (1 Feb. 1826) by Thomas Siviter the younger of Rowley Regis, Staffs., surgeon and Lydia his wife, to Thomas Siviter the elder of Rowley Regis, maltster, of a fifth part of a moiety of minerals under lands at Bourne Hills, and a fifth part of three fourth parts of the minerals under land at the Knowle, all parish of Rowley Regis; declaration of the uses of a Fine [levied by Lydia and the other 3 daughters of Edward Bridgwater and their husbands] in favour of Siviter the elder with reference to the shares conveyed; and assignment by Richard Gardner of Dudley, shopkeeper to John Willetts of the parish of Church Hill, Worcs., whitesmith, of two terms of 500 years in parts of the premsies, in trust for Siviter the elder and otherwise upon trust to attend the freehold; consideration of £750; covenant for production of title deeds by Joseph Bridgwater of Dudley, maltster; recites previous deeds.
DSCAM/5/6/5/16-17: Lease and release (20-21 Mar. 1839) by Thomas Siveter of Union Springs, Cayuga County, State of New York, United States of America, residing at Churchill, Worcs., surgeon, to Joseph Bridgwater of Dudley, maltster and Benjamin Lay of Dudley, maltster (his trustee to uses), of his one fifth share in three fourth parts of the minerals at the Knowle, to the use of Bridgwater, with power of appointment, as specified; consideration of £300; recites will of Siveter the elder etc. And related letter from Thomas Siveter to his 'brother' [Bridgwater] (3rd Mo. 22nd 1839), and memorandum (23 Mar.)
DSCAM/5/6/5/18-19: Lease and release (9-10 Apr. 1840) by Joseph Bridgwater and his mortgagees (William King, miller, Thomas King, gentleman and John Round, ironmaster, all of the parish of Sedgley, Staffs., as trustees and executors of Henry King; and Isaac Badger and Philip Williams, as above), to Thomas Smith of the Common-side, parish of Kingswinford, Staffs., yeoman and Levi Smith of the same, blacksmith, of three fourth parts of property at the Knowle (surface only); surrender of the mortgage term of 1000 years by King and Round to merge in the freehold; consideration of £950, of which £600 is to King and Round to repay mortgage and £350 to Badger and Williams to reduce the debt to them, to the use of Messrs Smith in moieties, with power of appointment, as specified, each Smith acting as trustee to uses to the other; plan endorsed.
Assignment (10 Apr. 1840) by Rachel Gardner of Stourbridge, Worcs., widow (and executrix of Richard Gardner), at the appointment and direction of William King, Thomas King and John Round, of Joseph Bridgwater, and of Thomas Smith and Levi Smith, to Joseph Green Bourne of Dudley, gentleman, of two terms of 500 years in parts of the premises, in trust for Messrs Smith and otherwise upon trust to attend the freehold.
DSCAM/5/6/5/20: Deed of partition (21-22 Sept. 1840) between John Smith of Withwood Heath, parish of Kings Norton, Worcs., blacksmith, a bachelor (eldest son and heir at law of John Smith of the same, who was eldest son and heir at law of Susannah, late wife of Timothy Smith of Shutt End, blacksmith, deceased, one of the daughters of Edward Bridgwater), Joseph Smith of Common Side, parish of Kingswinford, nailer, a widower (another son of Susannah), Thomas Smith of the same, yeoman, a bachelor (another son of Susannah) , Levi Smith of the same, blacksmith (another son of Susannah) and Sarah his wife, and William Smith of Shutt End, parish of Kingswinford, tailor (another son of Susannah) and Mary his wife, being an appointment and lease and release by them to John Bateman of Dudley, land surveyor, to their respective uses as specified of property and shares in property at Rowley Regis; 4 schedules showing property to the uses of John, Joseph, William, and Thomas and Levi; recites will of Edward Bridgwater etc.; plan endorsed shewing acreages, future ownership, course of canal.
