Description | DSCAM/5/12/5/1: Copy pre-nuptial settlement (dated 17 Nov. 1905) of Caleb Alan Bryce Whitefoord of Whitton Paddocks near Ludlow, Salop, gentleman and Evelyn Margaret Mary Whitefoord of 21 Willoughby Road, Hampstead, co. London, spinster; trustees are Lionel Cole Whitefoord of 21 Willoughby Road aforesaid, gentleman and Gilbert Slater of Dudley, Worcestershire, solicitor; recites will of Samuel Mills of Darlaston, grandfather of C.A.B. Whitefoord; £3500 out of husband's share under the will is transferred to the trustees, carrying interest at 4%, forming the 'A' Fund, paying income to husband for life, thence to wife; wife's securities form the 'B' Fund, to trustees to pay income to wife for life, thence to husband; after death of husband and wife, 'A' Fund in trust for the children or remoter issue in such manner as the husband shall appoint in his will at the age of 25 for a son or 21 for a daughter etc., with arrangements for bringing appointed sums into hotchpot etc.; 'B' fund in trust for children of the wife in such manner as she shall appoint by will, etc.; power of trustees to vary investments, to raise up to half of expectant, presumptive or vested shares for the benefit of children; in deafult of issue, husband and wife have power of appointment over their respective Funds, and in default of appointment the funds are to distributed according to the rules governing intestacy; failure of trusts over income permits trustees to apply it for the maintenance of the husband etc.; assignment of furniture by him to them in trust for his wife absolutely; attached schedules of furniture and of wife's stocks and shares. |
