Description | DSCAM/5/12/1/1: Copy of the will (dated 19 Nov. 1864) of Samuel Mills of Darlaston House, Darlaston, Staffs., Esq., late an iron master and coal owner; household effects to wife, Phebe; horse and dead farming stock and instruments of husbandry at Court Farm and the Whiteway Head Farm at Whitton near Ludlow, Salop, his freehold farm at the Delves in the parish of Wednesbury, Staffs., his freehold farm at Great Barr and leasehold farm called the Brockhurst in the parish of Wdnesbury, to son Richard at the age of 21, otherwise to sink in residuary personal estate; mourning rings to Thomas Tilley and John Tilley; annuity of £800 to wife and of £8 to Elizabeth Fisher of 2 Western Terrace, Hunter's Lane, Handsworth, Staffs.; 5/- a week to Thomas Rock and William Lumm, both of Darlaston, iron workers 'my old and faithful servants'; appoints James Slater (son-in-law), Martha (daughter) and Richard (son) as executors and trustees, the last on his majority; wife and first two trustees to be guardians of infant children; £5000 upon trust for Martha for life, thence to her children in such manner as she shall appoint, which failing to all equally as tenants in common at the age of 21, in default of which to his own issue equally as tenants in common, remoter descendants taking equally per stirpes; Darlaston House and estate upon trust to pay income to wife for life, thence to children equally as specified; Court, Whiteway Head and Whitton farms, all at Whitton, in trust to pay income to Martha for life, thence subject to the same powers and provisions as the £5000; freehold farms at Great Barr and the Delves upon trust to pay income to son for life, thence to the son's issue with power of appointment etc., and remainder to testator's own issue as tenants in common; freehold property in Darlaston and Wednesbury and freehold factory in Bell Street, Darlaston, to be divided into 7 shares upon his youngest child reaching majority, upon trust for his children (Ellen, wife of the Revd James Loy; Elizabeth, wife of James Slater; Phebe, Mary, Anna, Richard and Jane), each cestui que trust to receive the income for life, thence to the issue of each with power of appointment etc. and otherwise equally, with remainder in default of issue to testator's other children, except Martha, equally as specified; residue of real and personal estate upon trust for sale, the income arising to be applied to paying the annuities, and subject thereto, to be divided into 7 shares upon trusts the same as those governing the Darlaston and Wednesbury freeholds; powers of management of trustees; leasing powers; Darlaston House estate not to be sold without wife's authority in her lifetime; grandchildren benefiting from power of appointment to bring such into hotchpot; any daughter may appoint by will up to £100 p.a. of the income of her trust; applicatio of funds for maintenance and education; powers of trustees respecting agreements made by testator on 3 Aug. and 19 Oct. with Samuel Lloyd, Joseph Foster Lloyd, Wilson Lloyd and William Henry Lloyd, and Sampson Lloyd, Thomas Lloyd, Sampson Lloyd Foster, Edward Rigge Lloyd, William Bevington Lowe, Sampson Lackary Lloyd and Edward Jones, for the sale of iron works and collieries etc. |
