DescriptionDuplicate deed between John Cresswell of Birmingham, Warwickshire, builder and general undertaker and Benjamin Horton Eberhard of Dudley, Worcs., brickmaker and general undertaker, dissolving their partnership of 27 Apr. 1865 (Cresswell and Co.) as general undertakers at Birmingham and hotel keepers and stone masons at Witton, parish of Aston, near Birmingham, from 21 Nov.; assignment by Eberhard to Cresswell of his moiety of a warehouse etc. at 159-160 Great Charles Street, Birmingham, in a messuage and shop at 11 Aston Road, Birmingham used by the partnership and occupied by Cresswell, for the residue of their respective leases; consideration of £600; mutual covenants; Eberhard will not carry on business as an undertaker for 10 years within the borough of Birmingham or a 10 mile radius; recites that moiety of Witton property has been assigned by Eberhard in an indenture of even date.
