DescriptionDSCAM/3/481/1: Probate (28 May 1777) of the will (dated 16 July 1776)of Mary Withers of Birmingham, Warwickshire, wife of Benjamin Wither, made pursuant to powers in her marriage settlement; various jewels and ornaments to Charlotte Yenn, daughter of Richard Yenn the elder, late of Ashby De-la-Zouch, Leicestershire, now of Birmingham, poulterer by testatrix's niece Sarah; others such to Elizabeth Smith, Guest Pitt Withers alias Pitt Guest Withers and Bridgett Carless, grandchildren of her husband; linen to Sarah Yenn; two freehold messuages in Moat Lane, Birmingham, to husband for life, then one to Richard Yenn the younger and the other to Charlotte Yenn, with cross remainders etc., and ultimate remainder to the surviving issue of Sarah Yenn as tenants in common; 3 sittings in Deretend Chapel, parish of Aston, Warwickshire, to Charlotte and Richard Yenn the younger, and their sister Hannah Yenn, as tenants in common; sitting in St Martins Church, Birmingham, to Mary, wife of William Johnson of Bimingham, innholder; £180 mortgage from John Richards of Birmingham, to husband for life, then £166 to William, Ann, Hannah and Sarah, the children of niece Sarah Yenn; £5 each to Elizabeth, wife of William Ball of Moseley, Worcs., yeoman and to Elizabeth their daughter; £2 each to executors; residue to husband but subject to any payments under the will of her first husband, William Hopkins; executors, William [Grant] of Birmingham, baker and Thomas Farmer of Birmingham, bellows maker.
DSCAM/3/481/2: Assignment of legacy (4 Jan. 1779) by William Yenn of Appleby, Leicestershire, woolcomber and Hannah Yenn and Sarah Yenn of Birmingham, spinsters (3 of the children of Sarah Yenn), to, to Benjamin Parker of Birmingham, gentleman, of their interest in the £166 legacy, to the use of William Grant, with power of appointment; consideration of £10 to William and £5 each to Hannah and Sarah, and £2 p.a. to each of them for 8 years by Grant; recites death of Ann Yen in lifetime of Mrs Withers.
DSCAM/3/481/3-6: Copy notice of declaration, in James Bourne the elder, James Hancox, Joseph Bourne the younger, Joseph Everett and Elizabeth Payton (Plaintiffs) v William Grant (Defendant), 20 Apr. 1785; bond (6 Sept. 1785) of William Grant of Birmingham, farmer, to Joseph Bourne the elder, James Hancox and Joseph Bourne the younger, all of Dudley, Worcs., coal masters, and Joseph Everett of Hackney, Middlesex and Elizabeth Payton of Stratford upon Avon, Warwickshire, spinster, in £225 6/- to secure £112 13/-; related warrant of attorney (6 Sept. 1785) to confess judgment in the King's Bench in £225 6/-; memorandum of the deposit of #2 with Messrs Bourne and Co. as collateral security, 6 Sept. 1785.
