DSCAM/3/260/5: Copy pre-nuptial settlement of David Leech and Hannah Wilkinson (dated 12 Sept. 1821), between Leech and Turner his trustee, and Hannah Wilkinson of Himley, Staffs., spinster and Thomas Hawkes of Himley, Esq. and Joseph Green Bourne of Dudley, gentleman (trustees), settling lands at Duntons Piece, with 4 messuages, upon trust for Leech for life, then to secure the payment of an annuity of £28 to Hannah for life, and paying the balance to the persons otherwise entitled to the freehold, with covenant by David to effect the payment of £100 to the trustees in trust for Hannah or to such uses as she shall appoint, with remainder, in default of appointment to her personal representatives; attached receipt for £100 and interest, 19 May 1853. |
DSCAM/3/260/6: Probate (6 Oct. 1847) of the will (dated 4 July 1839) of David Leech of Dudley, gentleman; 2 dwellinghouses in Bond Street, Dudley, and all household effects, to wife, Hannah Leech, during widowhood, then for sale; 2 messuages in Oakey Well Street, 1 more messuage adjoining, and 1 in Summer Row, Dudley, to Ruth, wife of son Matthew Leech, for life, then upon trust for Matthew for life, then to pay the rents to Matthew's children until the death of the last of the testator's 4 children, and should Matthew die childless, to pay the rents to the testator's other children, with benefit of survivorship; messuage in Oakey Well Street, 1 in Summer Row and 2 in Spring Row, Dudley, to daughter Prudence, wife of Richard Chamberlain, for life, thence upon trust for her husband for life, thence for their children during the lives of the testator's other children, and in default of issue to pay the rents to the testator's other children, with benefit of survivorship; 1 messuage in Oakey Well Street, 1 in Summer Row and 2 in Spring Row, to son James for life, thence to his issue during the lives of the testator's other children, etc.; 1 messuage in Oakey Well Street, 2 in Spring Row and 1 behind, to son Edward for life, thence to his issue etc., etc.; and then all 16 houses upon trust for sale, with the proceeds paid to testator's grandchildren equally as tenants in common (with remoter issue taking per stirpes), with remainder in default of surviving grandchildren, to the children of William Wilkinson of Porters Fields, Dudley and of John Wilkinson of Wordsley as tenants in common; proceeds from Bond Street and household effects, equally to 4 children as tenants in common, but taking into hotchpot the £102 advanced by testator to his son Matthew and £50 to Prudence; executors, John Baugh, Joseph Pitchfork and Hannah Leech (wife).
Codicil (dated 9 Feb. 1842), whereby after death of son Edward, latter's wfe Maryann, is to receive rents in order to maintain and educate grandchildren, of whom she is to be sole guardian; if marriage settlement trustees demand the £100, the 2 houses in Bond Street devised to wife for life/during widowhood are to be sold and the £100 found from the proceeds, with the balance being invested for wife for life, and thence to fall into the estate. |
