DSCAM/3/224/3: Agreement (29 Dec. 1854) between Phoebe Shorthouse, wife of Thomas Shorthouse the younger of Dudley Port, parish of Tipton, accountant, and her husband, and William Hopkins of Dudley Port, coal and iron master, made to give effect to the intended changes in the will of John Hopkins [d 1854], their father, whereby his two children would be placed on an equal footing; a moiety of testator's interest in the partnership property of Hopkins and Son to become the property of William; partnership property to be valued and Phoebe to be bought out. |
DSCAM/3/224/4: Mortgage (21 Dec. 1857) by William Hopkins, at the direction of Phoebe Shorthouse, to George Andrews of Dudley, Worcs., gentleman and George Monnington Waring of Tipton, Staffs., registrar, of lands, mines, buildings, plant and machinery at Dudley Port (as specified), to secure £3600 (being half of the value of the late John Hopkins in the partnership with William, less £8 4s 1d paid by William to Phoebe, payable under the 1854 agreement), repayable as specified in instalments, six of £500 and one of £600, plus interest, by 29 June 1862, and subject to a prior charge for £10000 to the Dudley and West Bromwich Banking Company; recites previous deeds, demolition of old blast furnaces, erection of new furnaces, cupolas and works, charges in favour of the bank, will of John Hopkins (above), the 1854 agreement and subsequent actions, etc.; schedule of plant; attached notice to the bank as prior mortgagees.
Endorsed: 20 Apr. 1864: Assignment by Andrews and Waring, at the request of Phoebe, to Thomas William Stillard of Sedgley, Staffs., workhouse governor, of the mortgaged premises, to the use of Thomas Shorthouse, and assignment to Thomas of the sum of £2600, being the balance due on the morgage; recites settlement of 25 June 1859 (below), receipt of 2 instalments and of interest to 29 June 1862, the appointment of 19 Apr. 1864 |
DSCAM/3/224/5: Settlement (25 June 1859) by Thomas Shorthouse of Dudley Port, agent and Phoebe his wife upon George Andrews of Dudley, Worcs., gentleman and Thomas William Stillard of Sedgley, Staffs. (trustees), of Phoebe's half share of the estate of her late father, John Hopkins, and the £3600 mortgage secured on the partnership premises, being part payment under the 1854 agreement of her interest in the partnership assets and premises, in trust to pay the income to Phoebe for life (reserving to her a general power of appointment over the trust funds), thence to Thomas Shorthouse for life, then to divide the capital between the Shorthouse children at the age of 21 etc.; portions of £500 to be raised for each son at 21; power of appointment to Phoebe and, after her death, to Thomas to authorise the advancing of children's shares etc,; remainder, in default of issue, to the uses of Phoebe's will, and in default of such an appointment, in trust for Thomas, his heirs and assigns. Attached schedule of securities, mortgages etc. (some on Primitive Methodist chapels). Certificate of acknowledgment by a married woman.

5 Oct. 1864: Absolute appointment by Phoebe to Thomas of her interest in £450, sale proceeds of property at Dudley Port.
13 Jan. 1869: Absolute appointment by Phoebe to Thomas of her interest in £120 and £1480 purchase monies.

DSCAM/3/224/6: Assignment (20 Apr. 1864) by Andrews and Stillard to Thomas Shorthouse of the securities appointed to Shorthouse the previous day (see above); attached schedule of securities as per 1859 deed, and schedule of monies advanced out of the testator's estate by his executors for a copartnership debt to the Dudley and Westbromwich Banking Company, but assumed by William Hopkins under the arrangement with Phoebe. |
