DescriptionDSCAM/1/3/2/1: Attested copy deed of exchange (dated 27 Jan. 1752) between John, Lord Ward, Baron of Birmingham and James Shaw of Dudley, Worcs., gentleman; conveyance by Ward of 2 closes of land (4a. 2r. 35p.) and the Brownings (3a. 2r. 17p.), at Dudley, reserving minerals, for a term of 970 years; in exchange for 2 closes of land called the Foxholes (5a. 2r.) at Eve Hill, a small plot of land near Cradley Forge and a plot called Cinder Bank, both parts of Smithy Croft, reserving minerals, for a similar term of 970 years. Examined, 11 July 1804.

of John, Lord Viscount Dudley and Ward [1st Viscount].

Willingsworth Hall, Wiggens Mill and related lands in the parish of Sedgely, Staffs., Delves Farm and mill etc. in the parishes of Wednesbury, Walsall and West Bromwich, Staffs., and several messuages in Wednesbury (tenants given), to eldest son, the Hon. John Ward and the heirs male of his body, with remainder to youngest son, the Hon. William Ward and the heirs male of his body, with remainder to nephew, Humble Ward (only son of late brother the Revd William Ward) and the heirs male of his body, and ultimate remainder to own right heirs; various powers of appointment.

Manors of Bellbroughton, Forfield and Bromhill and all messuages and lands in the parish of Bell Broughton, Worcs., the capital messuage of Park Hall and lands in the parish of Sedgeley, and Sedgely Lodge and lands, Sedgely Park (400 acres), cottages in Ettingsall Lane (tenants given), lands called the Ewins, messuage and lands called Eightmore lands, and other lands and cottages in Sedgeley, lands calloed the Stone Pitts, Hangate Field, Hen Ruddings, Colletts, the Spon and various other messuages and lands in Ettingsall and Coseley in the parish of Sedgley, premises at Sinderhill, Cosely Hall, in the villages of Sedgly and Gospell End etc., etc., to youngest son, William Ward for life, then to his sons successively in tail male, with remainder to testator's eldest son, John for life, thence to John's sons successively in tail male, with remainder to the Humble Ward for life, then to his sons successively in tail male, and ultimate remainder to the testator's right heirs; tenant for life in possession given powers to jointure and raise portions (£4000 total).

Taylor's mortgage of premises at Bellbroughton and Bromsgrove, to son William; farms and lands called the Old Parke, parish of Dudley charged with £800 jointure to wife, in addition to and because of insufficiency of premises so charged in marriage settlement; residue of real estate to the Hon. John Ward for life, then to his sons successively in tail male, remainder to William Ward for life in like fashion, then to Humble Ward for life similarly, with ultimate remainder to testator's right heirs; powers to tenant for life in possession to jointure (£800 p.a., plus 8% p.a. in jointure for any amount wife's own fortune exceeds £10000) and raise portions (£10000-£20000 in varying circumstances outlined).

Household effects in Hyde Park Street, parish of St George Hanover Square, and house, to Lady Dudley for widowhood, she to select up to 500oz. of plate from Himley; then house to eldest son for remainder of lease, and all furniture and effects; mining equipment to son; furniture and pictures etc. at Himley settled as heirlooms to go with the house; £10000 charged on estates as portion for son William in terms of testator's marriage settlement, to be paid at the age of 25 with 4% interest from death of testator, with sliding scale of amount from the interest to be paid for maintenance and education or, latterly to William direct; appoints wife as guardian for William.

The moiety of all negroes, cattle, utensils and effects in Jamaica to which he is entitled in right of Lady Dudley (which descended to her and her sister from the late John Carver), and the wharf and premises purchased jointly by him and Mrs Carver, to Lady Dudley for life, then to son William, and then to the persons entitled to William's share of the Jamaica plantations; crops, sugar and rum to Lady Dudley; provisions for Jamaica estate and the £3700 mortgage upon it depending on who succeeds, whether they descend from the testator or not (John Guiry De la Chapell, illegitimate son of John Carver being in remainder).

House in Brook Street with fixtures to son William (in possession of Mrs Carver); coaches etc. and pair of coach horses and £500 to Lady Dudley; annuity of £50 to sister, Mrs Anna Ward and £100; to sister Mrs Rooke, £100 and same to the widow of his late brother the Revd William Ward; £1000 to nephew Humble Ward, and same to Humble's sister, Frances Ward; £100 each ro Richard Keeling and his son, John Keeling; residue of personal estate to eldest son, John Ward; executors, John Ward and testator's wife, Lady Dudley.

Codicil (21 June 1768); tithes of Dudley and tithes and rectory of Rowley Regis, to son John for life, with usual remainders; house and land in Bellbroughton to son William for life, with usual remainders.

Codicil (22 June 1770); lands in Kingswinford purchased of Lord Montrath and Sir Henry Bridgman, and lands purchased as specified in the parishes of Dudley and Sedgely, to son John for life, with usual remainders; lands purchase in Bellbroughton and in Catwal End near Sedgley, to son William for life, with usual remainders; purchases of lands and slaves in Jamaica, to Lady Dudley, then to youngest son [William] 'and the person who for the time being shall be intitled to Lady Dudley's plantations in that island'.
DSCAM/1/3/2/3: Copy of the will (dated 20 Jan. 1775) of James Shaw of Dudley, gentleman; all to wife with trust for sale, to be applied to her own maintenance and that of children, thence to those children to be divided as wife shall direct; wife is sole executrix.
DSCAM/1/3/2/4: Attested copy of the will (dated 16 July 1788) and codicil (21 July 1788) of John, Lord Viscount Dudley and Ward [2nd Viscount]; £200 p.a. to be raised for the maintenance and education of daughter, Anna Maria Ward; residue of rents to accumulate for her at the age of 21 or marriage; should she die a minor, half the rents to be applied for the benefit of William Humble Ward, son of late cousin Humble Ward, during his minority, and other half to cousin Mrs Shirley; after payment of debts and sales necessary in that connexion, trustees to settle estates to the use of Anna Maria for life, then to her sons successively in tail male, with remainder to her daughters as tenanst in common in tale general, with remainder (as to a moiety of the estate) to William Humble Ward for life, thence to his sons successively in tail male, with remainder to Frances Shirley, wife of the Hon. Washington Shirley for life, then to her sons successively in tail male, and (as to the other moiety), to Frances Shirley for life, then to her sons successively in tail male, with remainder to William Humble Ward for life, thence to his sons successively in tail male, and upon failure of the issue male of Shirley and W.H. (surviving executors of the 2nd Viscount Dudley and Ward), Horace St Paul, late of Chertsey, Surrey, now of Ewart House, Northumberland, Esq. and the Revd Henry Jerome De Salis (trustees with Vernon under the will), and Horace David Cholwell St Paul of Ewart House, Esq. and Anna Maria his wife (the residuary legatee of the personal estate of the 2nd Viscount), to William, Lord Viscount Dudley and Ward, Baron of Birmingham, of part of the premises subject to the 1752 exchange; consideration of £100.

DSCAM/1/3/2/20-22: Bargain and sale and enfeoffment (14 July 1825) by Benjamin Hughes of Birmingham, merchant, to James Bourne the elder of Dudley, gentleman and Joseph Green Bourne of Dudley, gentleman (his trustee to uses), of a wedge of 302sq. yds of land at Eve Hill, adjoining two new roads, to the use of James, with power of appointment, as specified; consideration of Bourne giving up other lands; livery of seisin endorsed; plan endorsed. Agreement between Bourne and Hughes (13 July) for the exchange of lands to consolidate holdings relative to roads to be constructed on a building estate at Eve Hill.

DSCAM/1/3/2/23: Grant (21 Apr. 1838) by James Shaw of Birmingham, Warwickshire, gentleman, to Joseph Bennitt of Dudley, iron merchant, in trust for Joseph Green Bourne of Dudley and Herbert Dudley Bourne of Cawney Bank, parish of Dudley, gentlemen (surviving devisees in trust of James Bourne), of the reversion in the lands assigned to Bourne in 1804, and the underlying minerals; consideration of £5; recites minerals are of no value to Shaw because of contingent liability for surface damage, and that the Bournes want to clear things up the better to sell the lands for building development.
