Parcel of land (3a) on the south side of Gornal Wood, Sedgley, a furnace and steam engine being lately erected there by ii) and with the liberty of taking water from a pool contiguous to the furnace in the possession of Messrs Parkes called Fillwell Pool for the purpose of condensing the steam used in working the fire engine only. Excepting all mines or minerals reserved to i) (upon regulations and conditions).

Recites will of John, Viscount Dudley and Ward, father of i) [13 Jun 1765].

Conditions: ii) to spend £3,000 within 2 years 'in erecting and completing a furnace for making and smelting of Iron and in other buildings and improvements' and to keep same in good repair.

Rent: £3 Also, all mines and minerals in a parcel of waste ground called Gornal Wood, Sedgley, several closes of land in the occupation of Messrs Parkes called the Lodge Farm and several inclosures of land from the waste called Gornal Wood.

Also all heathen coal lying under the ironstone strata and the mine of thick coal. With permission to enter into the land and dig, bore, etc. , to erect necessary fire engines, cranks, etc. to extract the minerals and to use the roads, etc. for working and carrying away the minerals. ii) must compensate land holders for any damage.

Rent: 3s for every bloom of ironstone (no less than 1,500 blooms); 6d for each ton of Heathen coal and 11d a ton for other coal [measurements specified]. Rent to be advanced if the average price of coal should rise.

With specified conditions including that an account should be kept of the ironstone/etc. mined and that the mines should be kept in a 'workmanlike' manner.

Also, provision for ii) to buy lime and limestone from i) upon account. Prohibits the use of minerals and lime not belonging to i), with provisions and allowance to bring Refuse Ironstone or Ironstone Binds 'for the better fluxing the Ironstone' for cast iron or pigs at the furnace. i) to pay ii) £1 per acre taken for the purposes of getting and working mines, etc. and will not sink any pits within ii)'s buildings.
