Several pieces of land at or near to the Delph, Kingswinford (30a) [occupiers given]; plot of unenclosed land adjoining on east (¾a) lately exchanged with Elizabeth Aston, Widow and others for carrying on the manufactory and opening a communication to the Stourbridge Navigation.
With appurtenances. Excepting all timber, trees and saplings: i) having the right of ingress, egress and regress to remove, etc. Also excepting all mines of coal, ironstone and all other mines and minerals (excepting as demised below), which i) reserves the right to mine and work, etc.
Recites will of John, Viscount Dudley and Ward [13 Jan 1765].
Consideration: premises, rents, covenants, etc.
Rent: £32 and taxes etc.
With provisio of repossession on non-payment and that ii) to keep lands in good repair.
Also, lease of 21 Years for all mines, veins and stata of Glasshouse Pot Clay, Fire Brick Clay and Potters Clay in and under premises leased and also in or under all other lands and tenements of i) in Kingswinford and in any land allotted by Act of Parliament 24 Geo. III for enclosing the Manor of Kingswinford where clay can be mined doing no injury to buildings.
Also, all mines of common brick and tile clay under lands demised and other lands of i) in Kingswinford in the occupations of Henry Barnsley and Joseph Seager. With libery to dig, bore, etc., sink pits, etc., erect engines, cranks, etc.
Also to mine the broach or offal coal (doing no damage to the collieries) for the use of fire engines for draining water, etc. (without royalties) and for the manufactory and works (at a fair royalty). Compensation for damage to be paid.
Royalties: for Best or Glasshouse Pot Clay 9s per ton; for Second Quality Glasshouse Pot Clay 5s per ton; for Offal or Ordinary Pot Clay 2s 6d per ton; for Potters Clay 2s per ton; per each 1,000 of quarries, cress and gutters shall manufacturer from the common surface brick clay 2s 6d and per 1,000 of bricks and tiles 1s 6d [measurements given], with a minimum of £500 to be paid annual (if resources there to be found)
Consideration: premises, royalties, payments and allowances
Provisio: upon default, i) to enter possession; an account to be kept of weights and amounts raised or made; i) may inspect premises; premises to be worked in a workmanlike manner; compensation ot be paid for damage.
Also i) having agreed with John Kidson of Wolverhampton, Butcher for the purchase of several tenements with gardens and mines underneath at the Delph, Kingswinford contiguous to the works and premises in order to accomodate premises, i) may hold and enjoy tenements for £15 per annum and to raise the mines for clay (upon above conditions) and to erect buildings, etc. i) also entitled to the benefit of the Contributory Rate for allotment holders under the Act for satisfying the damages sustained by the getting of mines.
